Welcome to Peninsula Therapy Hub! We are committed to providing quality paediatric play therapy services designed to support the developmental, emotional, and behavioural needs of children. These Terms and Conditions are intended to outline the mutual expectations, rights, and responsibilities of both Peninsula Therapy Hub and our valued clients and their guardians.

Our objective is to create a safe, supportive, and effective therapeutic environment. Adherence to these Terms and Conditions ensures that our services are delivered with the highest standard of professionalism and care. Please take the time to review this document carefully, as it contains important information about the provision of our services, privacy, confidentiality, payment terms, and other relevant aspects of therapy.

By engaging with Peninsula Therapy Hub and utilising our services, you, as the client or the guardian, agree to be bound by these Terms and Conditions. We encourage open communication and invite you to reach out to us with any questions or concerns regarding this agreement, so we can address them promptly and ensure your comfort and understanding.

Thank you for entrusting Peninsula Therapy Hub with your child’s therapeutic journey. We look forward to working together to achieve positive and meaningful outcomes.

 

2. Definitions

In this document, key terms are defined to ensure clarity and mutual understanding between Peninsula Therapy Hub and clients.

Therapy Services

Refers to the range of therapeutic interventions, treatments, assessments, and consultations provided by Peninsula Therapy Hub, designed to address the developmental, emotional, behavioural, and psychosocial needs of children.

Client

Denotes the child receiving therapy services from Peninsula Therapy Hub and, where applicable, includes their parent(s), guardian(s), or authorised representative(s).

Therapist

Refers to a qualified and accredited professional employed or contracted by Peninsula Therapy Hub to deliver therapy services. This includes, but is not limited to, occupational therapists, speech therapists, psychologists, and counsellors.

Confidential Information

Encompasses all non-public information, written or oral, disclosed through the course of therapy sessions, including personal details, medical history, therapy records, and any other sensitive information related to the client.

Consent

Involves a voluntary agreement by the client, or their parent/guardian, to the provision of therapy services, based on adequate knowledge and understanding of the purpose, nature, likely effects, risks, and benefits of the service.

Guardian

Denotes a person who has the legal authority (as a parental responsibility) to care for the personal and property interests of the child receiving therapy services.

Assessment

Refers to the evaluation process conducted by the therapist to identify the child’s developmental, emotional, behavioural, and psychosocial needs to determine the appropriate therapy services.

Intervention

Denotes the specific therapeutic approach or set of activities designed and implemented by the therapist to address the identified needs of the child.

Therapy Plan

Refers to the individualised plan developed by the therapist, outlining the goals, strategies, interventions, and duration of therapy services tailored to the client’s specific needs.

Session Notes

Encompass the written records maintained by the therapist, documenting the progress, observations, interventions, and outcomes of each therapy session.

Privacy Policy

Refers to the document detailing the ways in which Peninsula Therapy Hub collects, uses, discloses, and manages the clients’ personal and sensitive information.

Regulatory Bodies

Encompasses the governmental and professional organizations responsible for regulating and overseeing the delivery of health and therapy services, such as the Australian Health Practitioner Regulation Agency (AHPRA) and the National Disability Insurance Agency (NDIA).

 

3. Acceptance of Terms

Clients and their guardians acknowledge that by accessing and using our services, they are agreeing to be bound by these terms and conditions.

 

4. Services

All practitioners are qualified Child Therapists in their selected field. We use a combination of contemporary evidence-based treatments. Prior to commencing treatment, your practitioner will discuss their proposed treatment approach with you and ensure you understand the rationale for the approach, including any identified risks.

Peninsula Therapy Hub is a private provider of child therapy services.  Treatment is provided via prearranged, scheduled appointments. Practitioners have limited availability for contact outside of scheduled appointments.  Practitioners may not have an opportunity to respond to between session contact prior to your next appointment so this should not be relied upon for emergency matters. 

Peninsula Therapy Hub practitioners will only provide services that are within their professional capabilities, competence and role as a private provider of child therapy services.  If treatment needs are identified that are outside of this scope your practitioner will endeavour to assist you identify alternative suitable providers. 

 

5. Fees and Payment

A copy of our fee structure can be located on our website. You are responsible for paying at the time of your session unless prior arrangements have been made. Payment must be made by card.

In addition to scheduled appointments, your practitioner can charge this amount on a prorated basis for other professional services that you may require such as report writing, telephone conversations that last longer than 15 minutes, attendance at meetings or consultations which you have requested, or the time required to perform any other service which you may request of your therapist.

 

6. Cancellations and Refunds

You are required to provide at least 48 hours notice to cancel an appointment. This helps us to keep your session costs down, maximises our availability to clients and minimises lost clinical time. Appointments missed or rescheduled without 48 hours notice will incur the full fee which you must pay prior to your next scheduled appointment.

If you are late for an appointment your session may be less than 50 minutes in duration. Please note you will need to pay the full amount in these circumstances.  

If you provide us with a mobile number, a reminder message will be sent the day before your appointment.  This is a courtesy reminder only. If for any reason you did not receive a reminder message and missed your appointment you will still need to pay the late missed appointment fee.  If ever in doubt please feel free to telephone to confirm an appointment.

 

7. Client Responsibilities

Clients and /or Guardians have a responsibility to attend sessions when required and to participate in the session to the best of their ability

Whilst accessing services with Peninsula Therapy Hub, clients and or/guardians have the following rights and responsibilities:

• The right to be treated with dignity and respect and to have my choices and aspirations supported as far as is reasonably possible.

• The right to determine the range of activities that I wish to participate in.

• The right to privacy and confidentiality and in keeping with the Health Records Act 2001, to request access to any health information kept by Peninsula Therapy Hub.

 

I agree to:

  • Treat my provider with courtesy and respect;

  • Inform my provider about how I wish my supports to be delivered to meet my needs;

  • Give 24 hours of notice required for cancellations;

  • Give written notice if needing to end services;

  • Let my provider know immediately if my NDIS plan is suspended or replaced by new plan; and

  • Pay all fees owing by the due date

 

8. Privacy and Confidentiality

We are committed to handling client data in compliance with the Australian Privacy Principles.  Your child's treatment with Peninsula Therapy Hub is confidential and private.  This means we will not disclose the information you provide to us to third parties unless you consent for us to do so. It is important to note that there are limits to confidentiality in exceptional circumstances including when there is a risk to your child or others, or if we are responding to a subpoena or warrant. Your practitioner will discuss this with you during your first appointment and answer any questions you might have.  

As part of your practitioner's own supervision, as required for professional development purposes, a video recording or photograph of your child's session or artwork may be produced. These recordings and photographs will be retained for the duration of the play therapy and for as long as they are required for the purposes of the practitioner's supervision, following which they will be securely destroyed.

Peninsula Therapy Hub manages personal information it holds, including requests by individuals for access to their personal information, in accordance with the Privacy and Data Protection Act 2014 (Vic) and the Health Records Act 2001 (Vic).

 

9. Intellectual Property

The term "Intellectual Property" refers to creations of the mind, such as inventions; literary and artistic works; designs; symbols; names; and images used in commerce. In the context of our Paediatric Therapy services at Peninsula Therapy Hub, intellectual property includes, but is not limited to, therapy materials, techniques, methodologies, documents, artwork, and any content produced by our therapists.

A) Ownership

All intellectual property related to our therapy services, including therapy materials, methodologies, documentation, and any developed content, remains the exclusive property of Peninsula Therapy Hub. This includes any modifications or adaptations of the materials, regardless of who makes them, unless otherwise agreed in writing.

 

B) Usage

Clients and their guardians are granted a non-exclusive, non-transferable, revocable licence to use the therapy materials solely for the purpose of participating in the therapy sessions. Any other use of the materials, including copying, distributing, or modifying, is strictly prohibited without our written consent.

 

C) Confidentiality

Any confidential information, methodologies, or techniques disclosed during the therapy sessions are the property of Peninsula Therapy Hub and must be kept confidential by the clients and their guardians. Such information should not be disclosed to third parties without our written permission.

 

D) Client Contributions

Any content, artwork, or intellectual contributions created by clients during therapy sessions may be used by Peninsula Therapy Hub for research, development, and improvement of our services, with due regard to privacy and confidentiality obligations. Where appropriate, we will seek written consent from clients or their guardians for such usage.

 

E) Copyright

The copyright of all therapy materials and content, including any adaptations or modifications, remains with Peninsula Therapy Hub. Any unauthorized use, reproduction, or distribution of copyrighted materials is a violation of our rights and is strictly prohibited.

 

F) Intellectual Property Complaints

If you believe that our services or materials infringe upon any intellectual property rights, please contact us immediately with detailed information about the alleged infringement. We at Peninsula Therapy Hub take such matters seriously and will promptly investigate any such claims.

 

10. Liability and Indemnity

A) Limitation of Liability

Peninsula Therapy Hub, including its therapists, staff, and representatives, will not be liable for any indirect, incidental, consequential, or special damages arising out of or in connection with the use of our therapy services, whether or not such damages were foreseeable and even if Peninsula Therapy Hub was advised that such damages were likely or possible. This limitation of liability applies to damages for loss of profits, use, data, or other intangibles, as well as to damage for personal injury.

 

B) No Guarantee of Results

While we strive to provide effective therapy services, Peninsula Therapy Hub does not guarantee any specific results. Therapy outcomes can vary widely depending on individual circumstances, and we make no warranties or guarantees as to the effectiveness or timeliness of the services for each individual.

 

C) Indemnification

Clients and their guardians agree to indemnify, defend, and hold harmless Peninsula Therapy Hub and its employees, therapists, representatives, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) that such parties may incur as a result of or arising from any breach or alleged breach of these terms.

 

D) Insurance

Peninsula Therapy Hub maintains appropriate professional liability insurance coverage. Details of the insurance coverage can be provided upon request.

 

E) Notification of Issues

Clients and their guardians are requested to notify Peninsula Therapy Hub promptly of any issues, concerns, or dissatisfaction with the therapy services to allow timely resolution and to mitigate any potential damages or liability.

 

F) Governing Law

The laws of Australia and the relevant state or territory will govern any dispute arising out of or relating to the use of our therapy services. Clients and their guardians agree to submit to the exclusive jurisdiction and venue of the courts located in the relevant state or territory for any such disputes.

 

G) Severability

If any provision of this section is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining terms remain in full force and effect.

 

11. Complaints and Dispute Resolution

A) Raising Concerns

Clients and their guardians are encouraged to raise any concerns or complaints about the therapy services provided by Peninsula Therapy Hub as soon as they arise. Early communication of issues allows us the opportunity to address and resolve them promptly and effectively.

 

B) Formal Complaints

If clients or their guardians wish to make a formal complaint, they are requested to submit it in writing to our designated Complaints Officer. The complaint should provide detailed information about the nature of the concern, any relevant dates, individuals involved, and the desired resolution.

 

C) Acknowledgement of Receipt

Upon receiving a formal complaint, Peninsula Therapy Hub will send an acknowledgment of receipt within 5 business days, outlining the next steps and the expected timeframe for resolution.

 

D) Investigation Process

We are committed to thoroughly investigating all formal complaints. The investigation process will involve reviewing the details of the complaint, speaking to the involved parties, and examining any relevant documentation. Our aim is to resolve complaints fairly, effectively, and in a timely manner.

 

E) Resolution and Response

After completing the investigation, Peninsula Therapy Hub will communicate the findings and proposed resolution to the complainant in writing. We aim to complete this process within 10 business days from the receipt of the formal complaint, unless circumstances require additional time.

 

F) External Resolution

If the complainant is unsatisfied with the resolution proposed by Peninsula Therapy Hub, they have the right to escalate the complaint to external bodies such as the National Disability Insurance Agency (NDIA), the NDIS Quality and Safeguards Commission, or the relevant health ombudsman in Victoria.

 

G) Confidentiality

All complaints and information provided during the resolution process will be handled confidentially and in accordance with our Privacy Policy and the Australian Privacy Principles.

 

H) Continuous Improvement

Peninsula Therapy Hub values feedback and will use the insights gained from the complaint resolution process to review and improve our services continuously.

 

12. Termination of Services

This section outlines the conditions under which services may be terminated by either the client or the business.

Should you wish to end your child's sessions at Peninsula Therapy Hub, we require 2 sessions notice of termination in writing. The cost of the sessions will be required to be paid, whether or not you choose to attend these two final sessions with your therapist.

 

13. Governing Law

 

A) Jurisdiction

The terms and conditions of the services provided by Peninsula Therapy Hub are governed by and construed in accordance with the laws of the State of Victoria, Australia. This includes any regulations, guidelines, and standards applicable to children’s therapy services in Victoria.

 

B) Compliance

Peninsula Therapy Hub is committed to operating in full compliance with all relevant Victorian and Commonwealth legislation. This includes, but is not limited to, the Health Practitioner Regulation National Law (Victoria) Act 2009, the Children’s Services Act 1996, and the Child Wellbeing and Safety Act 2005, as well as any amendments and regulations made under those Acts.

 

C) Dispute Resolution

In the event of a dispute arising out of or in connection with the services provided by Peninsula Therapy Hub, both parties agree to first attempt to resolve the dispute through negotiation and mediation before resorting to litigation. Any such dispute that cannot be resolved amicably shall be submitted to the exclusive jurisdiction of the courts located in Victoria, Australia.

 

D) Regulatory Bodies

Peninsula Therapy Hub acknowledges the role of relevant regulatory bodies such as Australasia Pacific Play Therapy Association (APPTA), the Australian Health Practitioner Regulation Agency (AHPRA), the NDIS Quality and Safeguards Commission, and the Department of Health and Human Services Victoria, and commits to cooperating with any inquiries or investigations conducted by such entities.

 

E) Updates and Amendments

Peninsula Therapy Hub reserves the right to modify its services to ensure compliance with any changes in the governing laws and regulations. Clients will be notified of any significant changes that affect the provision of services.

 

F) Legal Advice and Interpretation

Clients and their guardians are encouraged to seek independent legal advice if they have any concerns regarding the applicability or interpretation of the governing laws and how they may impact the therapy services received from Peninsula Therapy Hub.

These provisions serve to reinforce the commitment of Peninsula Therapy Hub to operate within the legal frameworks of Victoria and Australia, ensuring the protection and well-being of the children availing of their services.

 

14. Amendments

We reserve the right to update or amend these terms and conditions. Current clients will be notified of any changes via email.
